Terms and Conditions of Use

These Terms and Conditions govern access to and use of the Corpshore Colombia website. By browsing the site you accept these terms. If you do not agree with them, please refrain from using the site.

1. Acceptance

By accessing the Corpshore Colombia website you declare that you have read, understood and accepted these Terms and Conditions, along with the Privacy Policy and the Cookie Policy that complement them.

These terms apply to everyone who accesses the site, regardless of the place from which they do so.

2. Purpose and scope

The purpose of the website is to present the services of Corpshore Colombia in business process outsourcing (BPO), IT outsourcing and artificial intelligence delivery, to facilitate contact with the company and to publish job opportunities and informative content.

The site is informative and commercial in nature. The information published does not replace professional advice nor does it constitute a specific recommendation for your particular case.

3. Definitions

Site: the website available at corpshore.co and its subdomains.

User: the person who accesses the site.

Content: the texts, images, graphics, trademarks, logos and other elements published on the site.

Services: the BPO, IT outsourcing and AI delivery services that Corpshore Colombia offers and which are contracted separately through specific agreements.

4. Use of the site

The user undertakes to use the site in accordance with the law, these terms, good faith and public order.

Access to the site is free, without prejudice to the cost of the internet connection provided by the user's operator.

Some functions of the site, such as the contact or application forms, require the user to provide truthful, accurate and up-to-date information.

5. Acceptable use

The user shall refrain from using the site for unlawful or unauthorised purposes, from introducing malicious code, from attempting to access systems or data without authorisation, and from carrying out actions that affect the operation of the site or the rights of third parties.

It is prohibited to extract data by automated means, to overload the infrastructure, to impersonate another person or to use the site to send unsolicited communications.

Corpshore Colombia may suspend or restrict access to the site for anyone who breaches these rules, without prejudice to any applicable legal action.

6. Intellectual property

The content of the site, including texts, images, graphics, the Corpshore trademark, the logos, the design and the code, is the property of Corpshore Solutions Corporation, of Corpshore Colombia or of their licensors, and is protected by intellectual and industrial property rules.

The user is authorised to view and use the content solely for personal and informative purposes. Any reproduction, distribution, public communication or transformation of the content requires the prior written authorisation of the owner.

Third-party trademarks and distinctive signs that appear on the site belong to their respective owners.

7. Third-party content and links

The site may include links to third-party sites and references to external content, such as press articles or industry recognitions. These links are offered for the convenience of the user.

Corpshore Colombia does not control or answer for the content, policies or practices of third-party sites. Access to those sites is at the user's own responsibility and is governed by the terms of each site.

8. Site information is not an offer or contract

The information about services, capabilities, indicative cost or saving ranges, locations and languages published on the site is general and informative in nature.

No content on the site constitutes a binding commercial offer, a firm quote or a contract. The ranges and estimates offered by the interactive tools on the site are indicative and representative, are not a quote, and do not bind Corpshore Colombia.

Any commitment by Corpshore Colombia arises solely from a written agreement signed between the parties.

9. How services are contracted

The services of Corpshore Colombia are contracted through a process that usually includes a discovery call, a proposal and the signing of a services agreement and the relevant data processing agreements.

The conditions of each service, including the scope, the service levels, the prices and the responsibilities, are agreed in that contract and prevail over the general information on the site.

10. Forms and communications

By submitting a form on the site, the user authorises Corpshore Colombia to use the data provided to attend to the request, in accordance with the Privacy Policy.

Applications to vacancies are treated for recruitment purposes and do not guarantee employment. Newsletter subscriptions are managed separately and may be cancelled at any time.

11. Site availability

Corpshore Colombia strives to keep the site available continuously, but does not guarantee that access will be uninterrupted or error-free.

The site may be suspended temporarily for maintenance, updates or causes beyond the reasonable control of the company, without this giving rise to liability.

12. Disclaimers

The information on the site is provided as is. Corpshore Colombia does not guarantee that it is complete, accurate or up to date at all times, and may modify it without prior notice.

Corpshore Colombia does not answer for decisions the user makes based on the general information on the site. For specific decisions we recommend contacting the company and obtaining a proposal.

13. Limitation of liability

To the extent permitted by law, Corpshore Colombia shall not be liable for indirect, incidental or consequential damages arising from the use of or the inability to use the site.

In any case, Corpshore Colombia's liability relating to the use of the site is confined to direct and proven damages, and does not include the loss of business opportunities, of data, of reputation or of expected profits. Service relationships are governed by their own liability regime, agreed in the respective contract, which prevails over this clause for those relationships.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under Colombian law.

14. Indemnity

The user shall hold Corpshore Colombia harmless against third-party claims arising from the misuse of the site or from the user's breach of these terms.

15. Data protection

The treatment of personal data carried out through the site is governed by the Privacy Policy and by Colombian data protection regulations, in particular Ley 1581 de 2012 and Decreto 1377 de 2013.

16. Modifications

Corpshore Colombia may modify these Terms and Conditions at any time. The version in force will be the one published on the site with its update date.

Continued use of the site after a modification implies acceptance of the updated version.

17. Electronic commerce and data messages

In accordance with Ley 527 de 1999, the data messages generated through the site, such as the submission of forms, are valid and have evidentiary force, and legal effect will not be denied to them merely because they are in the form of a data message.

The record of the acceptance of consents and of these terms, with its date and the version of the text accepted, constitutes proof of the user's expression of will.

18. Force majeure

Corpshore Colombia shall not be liable for any failure or delay in the operation of the site arising from events of force majeure or unforeseeable circumstances, such as failures in telecommunications networks, power cuts, cyberattacks, natural disasters or acts of authority.

In the event of one of these situations, Corpshore Colombia will endeavour to restore the service within a reasonable time.

19. Assignment

Corpshore Colombia may assign or transfer the rights and obligations arising from these terms to another entity of the Corpshore group or to a third party, within a corporate reorganisation, without this affecting the rights of the user.

The user may not assign their position under these terms without the prior written consent of Corpshore Colombia.

20. Severability and entire agreement

If any provision of these terms is declared invalid or unenforceable, the remaining provisions will retain their full validity, and the affected provision will be interpreted in the way that most closely approaches the original intention of the parties within what the law permits.

These Terms and Conditions, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between the user and Corpshore Colombia regarding the use of the site.

21. Language

These terms are published in Spanish and in other languages for the convenience of the user. In the event of a discrepancy in interpretation between the versions, the Spanish version will prevail, as it is the language of the controller's domicile and the one that governs the relationship under Colombian law.

22. Truthfulness and responsibility of the user

The user is responsible for the truthfulness and accuracy of the information they provide through the site, including contact details, professional information in applications and any document they attach.

Providing false or inaccurate information, or third-party information without authorisation, may lead to exclusion from a process, to the termination of the relationship and to any applicable legal responsibilities.

The user is responsible for keeping confidential the credentials or personal access links that Corpshore Colombia provides, and for immediately reporting any unauthorised use.

23. Use of the interactive tools

The site offers interactive tools, such as the cost and saving estimator, the service model configurator, the job finder and the career-path explorer.

These tools are for guidance. The ranges, estimates and recommendations they produce are indicative and representative, do not constitute a quote, an offer or a commitment, and may differ from the scope and price agreed in a contract.

Any result that a tool carries into a contact form is used only to prepare the commercial conversation and to draw up a precise proposal.

24. Vacancies and recruitment-fraud warning

The vacancies published on the site are managed through our official channels. Applying does not create an employment relationship or guarantee engagement.

Corpshore Colombia does not request payments from candidates at any stage of the selection process. If anyone requests money in the name of Corpshore as a condition for a job, it is a fraud and we ask you to report it to info@corpshore.solutions.

Always verify that the communication comes from an official Corpshore domain before providing information or documents.

25. Consumer protection

Where applicable, the consumer protection rules provided for in Ley 1480 de 2011 and other concordant rules are respected.

Requests, complaints and claims relating to the site may be directed to info@corpshore.solutions, and will be handled within the terms set by law.

26. Notices, waiver and validity

Notices to Corpshore Colombia relating to these terms are made to info@corpshore.solutions. Corpshore Colombia will communicate with the user through the contact details the user has provided.

Corpshore Colombia's tolerance or non-exercise of a right provided for in these terms does not imply a waiver of it nor prevent exercising it later.

These terms remain in force while the site is available. Corpshore Colombia may suspend or discontinue the site, in whole or in part, at any time.

27. Security and vulnerability reporting

Corpshore Colombia adopts reasonable measures to protect the site, but no system is completely secure. The user undertakes not to carry out security testing, scans or intrusion attempts without written authorisation.

If you detect a vulnerability or a security incident relating to the site, we ask you to report it responsibly to info@corpshore.solutions, without disclosing it publicly or exploiting it, so that we can address it.

28. Minors

The site and its services are directed at adults and organisations. Use of the site by minors is not permitted without the authorisation and supervision of their legal representative.

The vacancies published are governed by the applicable labour regulations, including the provisions on the minimum working age.

29. Termination and suspension of access

Corpshore Colombia may restrict, suspend or terminate a user's access to the site, without prior notice, when these terms are breached, when there is a security risk or when required by a competent authority.

The provisions that by their nature must survive termination, such as those relating to intellectual property, limitation of liability, indemnity and governing law, will remain in force.

30. Electronic communications

By using the site or communicating with Corpshore Colombia by electronic means, the user agrees to receive electronic communications relating to their request, and acknowledges that such communications satisfy any legal requirement to be in writing.

Commercial or marketing communications are only sent with the user's authorisation and always include a simple means to stop receiving them. The user is responsible for keeping their contact details up to date.

31. Geographic availability and interpretation

The site is administered from Colombia and is directed mainly at the markets that Corpshore Colombia serves. Access from other jurisdictions is at the user's own initiative, and the user is responsible for complying with the local regulations applicable to them.

The clause headings in these terms are included only to ease reading and do not affect their interpretation. References to Colombian rules are understood to be made to the version in force of each rule and to those that replace or amend them.

32. Indicative prices, user contributions and the relationship between the parties

Any price, rate or range shown on the site is indicative and for reference. Values may be expressed in United States dollars and in Colombian pesos for illustrative purposes, do not necessarily include taxes or charges, and the final price of a service is agreed in the corresponding contract.

If the user submits comments, ideas or suggestions about the site or the services, they authorise Corpshore Colombia to use them without restriction and without this generating any obligation of compensation, reserve or confidentiality in their favour, unless otherwise agreed.

Nothing in these terms creates a relationship of partnership, mandate, agency or employment between the user and Corpshore Colombia. Use of the site does not grant the user any right other than those expressly granted in these terms.

33. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Colombia.

Any dispute relating to the use of the site shall be submitted to the competent judges and courts of Colombia, without prejudice to the consumer protection rules that may apply.
